THE HAMILTON CYCLING CLUB Constitution & Rules Republished February 2005 Revised November 1994 1.Name
The name of the club shall be The Hamilton Cycling Club.
2.Objectives
The objectives of the club shall be to foster, encourage and promote racing, touring and mountain cycling and shall affiliate with the national and provincial bodies with similar aims.
3.Membership
Membership shall be open to any resident of Ontario. Applicants who are suspended or out of standing by or with a provincial, national 6r international athletic organization, or another cycling club, or who flagrantly breaches the constitution and rules of the club, may be suspended or denied membership in the Hamilton Cycling Club at the discretion of the executive.
4.Executive Officers
4.1 The executive officers of the club who shall be elected each year for the term of one year at the Annual General Meeting, will be as follows:
President
Who shall direct the activities of the club and act as the chair at all meetings of the club including the executive meetings
Vice President. Who shall assist the president and assume the president's duties in the president's absence.
Secretary
Who shall record the minutes of all club meetings and ensure its entry into the club newsletter as well as attend to the correspondence of the club. Racing Secretary Who shall organize and action any duties or requirements pertaining to all racing within the club.
Touring~Secretary
Who shall organize and action any duties or requirements pertaining to all touring within the club.
Recreation Director
Who shall organize recreational and entertainment events for the membership.
Newsletter Editor
Who shall publish, print and distribute a monthly newsletter to all members in so far as is possible or otherwise directed by the executive committee.
Treasurer/Membership Secretary
Who shall record all financial transactions of the club and accumulate a list of members and ensure that the list is published twice per year in the club newsletter.
5. Management
5.1 The management of the club affairs shall be governed by the executive committee, which shall consist of the officers of the club. Club affairs is defined as the normal business of running the club within concepts laid out in the constitution, rules and records. It shall not include purchase of real property, borrowing of money or anything contrary to the objectives of the club.
5.2 The executive committee shall endeavour to meet monthly but not less than nine months in the year in order to conduct club affairs. A quorum of five officers is necessary. All decisions shall be unanimous.
5.3 A summary of the minutes of each executive committee meeting will be published in the newsletter.
5.4 Each officer of the committee shall account to the committee for their actions and activities in the period since the preceding meeting.
The treasurer shall open and operate a bank (or similar financial institution) account in the name of the club. Signing authorities shall be in compliance with the articles of incorporation but in any event not less than two elected officers so designated, one of whom shall be the treasurer.
No liability shall be incurred by any officer of the club nor shall those with signing authority have authority to pay any bill which exceeds $200 that has not been authorized by the executive committee as to the purpose and amount.
The executive is empowered to fill vacancies in the committee caused by the resignation or other loss of one of its members.
The executive shall set fees for membership in the club and for club events. The executive is empowered to make members of the club honourary members.
6.Constitutional Changes
6.1 The club constitution and rules may only be amended by two thirds of the club members present at the Annual General Meeting or at an extraordinary meeting voting in favour of such a motion.
6.2 Any proposed changes or additions to the club constitution and rules must be published and distributed to the club members fourteen (14) days preceding the Annual General Meeting or the proposed extraordinary meeting. Such publication shall be either by way of the club newsletter or, if necessary, by written notification to each club member (with permission of the executive).
7.Annual General & Extraordinary Meeting(s)
7.1 The Annual General Meeting of the club shall be held in November of each year for the purpose of electing club officers, amending the club constitution and attending to the general business of the club.
7.2 An Extraordinary Meeting shall be held either...
a) at the behest of the executive committee or
b) at the written request (submitted to the executive) of 10% or more of the membership in good standing.
7.3 Meetings shall be conducted in compliance with the constitution and rules of the club and Roberts Rules of Order - the former taking precedence over the latter.
8.General Rules
8.1 Any member from the previous year shall cease to be a member if they have not paid their membership fee by April 1st and shall not receive further correspondence from the club. New members joining after July 31st of the current year will have their membership extended to December 31 St of the following year.
8.2 All members shall take it upon themselves to actively promote the club in all aspects and shall endeavour to recruit new members.
8.3 Family memberships shall be available to all members, with the fees set by the executive committee each year. All members of the family will be allowed full voting and membership privileges.
8.4 An honourary member is an individual who has proven himself worthy of a lifetime membership with full voting and membership rights. All present or past club members who have won first place in a Canadian Cycling Championship shall be an honourary member.
8.5 Club members shall obey all rules of the road as laid out under the Highway Traffic Act and for the purposes of racing and touring as laid out by the Ontario Cycling Association.
8.6 The official club jersey will be red with white panels and blue across the shoulders and arms. The words Hamilton Cycling Club will appear on the front and back.
8.7 Membership categories shall be:
Pee wee Over 9 years of age and under 11 years of age as at December 31St of the previous year.
Minime Over 11 years of age and under 13 years of age as at December 31st of the previous year.
Cadets Over 13 years of age and under 15 years of age as at December 31St of the previous year.
Juniors Over 15 years of age and under 18 years of age as at December 31st of the previous year.
Seniors Over 18 years of age and under 40 years of age as at December 31st of the previous year.
Veterans Over 40 years of age as at December 31st of the previous year.
Ladies A separate category for each of the aforesaid to which the female club member may be categorized.
Family A grouping membership for fee purposes - over and above the individual members age and gender category.
Hon ourary A status bestowed on a member over and above their age and gender category.
Membership fees for all categories shall be set each year by the executive committee after the Annual General Meeting in November and before December 31st of the same year.
9 Racing Rules
9.1 Members shall wear the club's clothing in all open races unless granted permission by the executive to race under the colours of another sponsor's racing team. Consent will be granted where a team offers support that is significantly superior to the Hamilton Cycling Club and seriously impedes the member's racing prospects.
9.2 Participation in club championship road and track events will be open to members of the Hamilton Cycling Club only. This is to eliminate possible outside interference from non-members which may influence the outcome of an event. This does not apply to time trial events so long as a non-member's time does not influence the outcome of a time trial event.
9.3 All club members must wear an ANSI, Snell or CSA approved bicycle helmet while participating in official club cycling activities.
9.4 Club championships will be as follows...
Overall Best All Round Champion....to be decided on a points basis of the overall performances in all club confined events. The first ten places in each designated confirmed event will be awarded points on the formula often points for first place down to one point for tenth place. Points are awarded to the individual in this B.A.R. event irrespective of category.
Veteran Time Trial Champion....to be decided over three events whose distances will be 15km, 40km and 8Okms. The times of the individual will be adjusted for age difference at the rate of .6 seconds a kilometre for each year of age difference from the age of 40.
Veteran B.A.R. Champion... to be decided over five events which shall be two road races of 40km and 80km, two time trials of 15km and 40km and one hill climb.
Senior Time Trial Champion... .to be decided over three events whose distances will be 15km, 40km and 80kms.
Senior B.A.R. Champ ion....to be decided over five events which shall be two road races of 40km and 80km, two time trials of 15km and 40km and one hill climb.
Junior Time Trial Champion... to be decided over three events whose distances will be two times 15 km and one 40km
Junior B.A.R. Champion.. ..to be decided over five events which shall be two road races of 40km and 80km, two time trials of 15km and 40km and one hill climb.
Cadet Time Trial Champion... to be decided over three events whose distances will be two times 15 km and one 40km
Cadet B.A.R. Champion.. ..to be decided over five events which shall be one road race of 40km, four time trials being two time trials of 15km and one 40km and one hill climb.
Ladies Time Trial Champion....to be decided over three events whose distances will be two of 15km and one of 40km
Ladies B.A.R. Champion....to be decided over five events which shall be two road races of 40km and 80km, two time trials of 15km and one of 40km and one hill climb.
Points will be awarded on the basis of ten points for first place down to one point for tenth place in each category. The winner of each category will be the individual who accumulates the greatest number of points over the year in the qualifying events.
Track Championships... will be held over the following criteria: Match Sprint (two up sprinting), 1,000m Time Trial, 3000m Time Trial, 10,000m Massed Start. Points will be awarded for the first four riders, regardless of category, on the basis of four points for first place to one point for fourth place. The rider accumulating the most points will be the Club Track Champion.
9.5 Riders will compete in their own category with the exception of the Overall B.A.R. Championship and the Track Championship -these events are open to all categories. Male and female veteran and junior members are permitted to ride in the senior category if they so wish. Male and female cadet members are permitted to ride up to the junior category. In all cases, this must be determined before riding their first event of the season and must continue throughout the season.
9.6 Where five or more riders enter a race the Club will award the first three prizes. Where there are less than five riders the Club will award the first prize only. Where there is only one rider, that rider will be awarded a prize but only if the bronze standard of time of that event is achieved.
9.7 There is no set minimum number of riders in a category for either the Time Trial Championship or the Best All Round Championship.
9.8 The club will recognize records for the following distances...

9.9 The following regulations will apply for the recognition of all time trial club records...
Times obtained in club events will be recognized provided that an accurate timing device (such as a stop watch) and a standardized system of measurement have been used. All official times obtained in open events will be recognised provided that these are in accordance with the club rules.
If the event is in miles, the time entered will be the time obtained in the event multiplied by the ratio of the closest eligible distance to the distance covered in kilometres. For example if a rider does 50 minutes 17.5 seconds for 25 miles, the time entered in the club records would be factored 40/40.2335 to equal 50 minutes 00 seconds for 4Okms.
9.10 A club member may submit a time obtained in an event run anywhere in the world, provided the event is run in accordance with club rules. A committee formed of the executive shall pass conformity of the event to the club rules and to the accuracy of the timing and measurement of the distance. If it is decided that sufficient departure from the club rules existed, the claim will be rejected.
It is the responsibility of the member claiming the record to submit independent evidence to support the claim. This may include an official result sheet or a statement signed by the event timekeeper and the timekeepers assistant or another witness.
The aforementioned not withstanding, should it be found later that the claim was false, or that the event was not conducted in conformity to the club rules, or that an error was made in the timekeeping or in the measured distance, the claim will be disallowed and the club record previously in existence will be reinstated.
9.11 All members who participate in club events and earn points which would make them eligible for the club B.A.R. or Time Trial Championships must be fully paid up members of the club to receive these awards.
